Bad Drug Lawsuits and the Protection of Rights Under Law

Medication lawsuits are one of the major issues in health care today. It is no longer a question of just one or two companies that have been sued, because so many different companies are being held liable for the injuries that have been caused by their products. The courts are allowing companies to be held responsible for damages that have been caused by their products, even if they have done nothing wrong. In the United States, the Food and Drug Administration sets the maximum compensation that can be paid out per claim, but there are no minimum requirements. This means that the amount of money that a person can receive for a defective or dangerous product, is determined by the company’s profitability. In recent years, many lawsuits have been directed towards the GlaxoSmithKline drugs. The company was pilloried in the press because it was found that their antidepressant medications were responsible for thousands of deaths and a huge amount of disability income.

The GlaxoSmithKline case represented a unique situation.

While they were found liable for many deaths and injuries, GlaxoSmithKline was able to successfully defend against claims of financial negligence. Many attorneys representing clients that have been affected by these drugs feel that they are all in GlaxoSmithKline’s favor, since they were found to be within the guidelines set forth by the FDA. This means that they were within the guidelines when they sold these drugs. They were not required to notify anyone that these drugs were dangerous, or that their use could result in injury or death.

In some cases these companies were fined large sums of money by the federal government and thousands of individuals have been injured as a result.
